Court expert opinion (peritaje judicial)

A court expert opinion (peritaje judicial) is the opinion issued by an expert with technical knowledge and submitted in court proceedings to assess facts or circumstances that the judge needs to understand.

In civil proceedings it is governed by article 335 of the Ley de Enjuiciamiento Civil (Spanish Civil Procedure Act). The opinion may be submitted by one of the parties or issued by an expert appointed by the court, and the expert has to state under oath or solemn promise that they are acting with the greatest possible objectivity.

In locksmithing, an expert opinion can be used to explain whether a lock was forced, by what method, or whether it was in good condition.

It should not be confused with the report we provide after a break-in for the police report or the insurer: that is the technical report of the person who has inspected and repaired the lock. We explain it on our forced lock report page. If your case is going to court, your lawyer will tell you what you need.
